EXPLANATION – The Responsible Gaming Agreement (RGA) is a legally binding agreement that outlines the terms and conditions for participating in games of chance offered by the Brand website. The agreement is concluded between the consumer (the Player), the Gaming Service Organizer and an appointed Intermediary to assist in resolving disputes. By accepting this Agreement, you agree to comply with the Gaming Terms and Conditions (GT&C). RESPONSIBLE GAMING AGREEMENT (RGA)

 

Article 1 and 2 – Services and Terms and Conditions

 

EXPLANATION – Articles 1 and 2 explain that by participating in games of chance you understand and accept that you may win or lose. The Agreement is accompanied by the Gaming Terms and Conditions (GT&C) and various Policies. Additional Guidelines may apply to specific in-game offerings, and accepting such offerings binds you to the applicable Guidelines.

 

Article 1

1.1. This Responsible Gaming Agreement (“RGA”) constitutes an offer under Article 6:217(1) of the Curaçao Civil Code (“CCC”) to the consumer (“You”, the “Player” or “End User”) to participate in games of chance (“Games”) where outcomes are determined predominantly by random or unpredictable events (“Gaming Service”). The Gaming Service is provided through a secure personal area (“Gaming Environment”) of the Brand 95asia.com, including any aliases, and is intended solely for personal entertainment.

1.2. The Gaming Environment is operated by Codex B.V., a company incorporated and established in Curaçao (the “Operator” or “Gaming Service Organizer”).

1.3. The Gaming Service is subject to the National Ordinance on Offshore Games of Hazard (NOOGH).

1.4. By placing a Stake (“Bet” or “Wager”), the Player binds value to an uncertain outcome. A favorable result results in a Prize; an unfavorable outcome results in forfeiture of the Stake.

1.5. The Operator may allow participation in Jackpot Games and Promotions. Promotions are incentives and do not constitute Prizes. Such offers may be temporary and subject to restrictions.

1.6. An independent Intermediary is appointed to resolve disputes by binding decision under Article 7:900(2) CCC. The Intermediary validates and registers all applicable rules and updates.

1.7. The Gaming Service and the Intermediary Service are jointly referred to as the “Services”.

1.8. Acceptance of this Agreement and the GT&C is mandatory to access the Services.

 

Article 2

2.1. The Gaming Terms and Conditions (“GT&C”) form an integral and inseparable part of this Agreement and include essential Policies.

2.2. The GT&C include, but are not limited to: Exclusion Policy, Account Policy, Withdrawal Policy, Information Policy, Promotions Policy, Anti-Abuse Policy, Dispute Policy, Complaint Policy, Liability Policy and Communications Policy.

2.3. Additional Guidelines may be provided to explain specific in-game offerings and features.

2.4. In-Game Offerings are temporary and governed by applicable Guidelines.

2.5. The Player is solely responsible for ensuring that use of the Gaming Service is lawful in their jurisdiction.

2.6. This Agreement represents the entire understanding between the Parties. Any invalid provision shall be replaced by a valid provision achieving similar objectives.

2.7. This Agreement and its performance are governed by the laws of Curaçao.

 

Article 3 – About the Gaming Environment

 

EXPLANATION – Article 3 explains that participation requires account registration. Not all credits can be converted into real-world value. The Operator may modify or terminate credit availability.

 

3.1. To participate in Games, the Player must register an Account. The Account contains Credit Balances (“Game Credits”) and related information.

3.2. Deposited Credits obtained through real-money deposits are considered Assets. Credits obtained through promotions may not hold monetary value. Credits resulting from chargebacks or reversals are not considered valid deposits.
